¿Cuáles son los sistemas jurídicos vigentes en el mundo?
Se establecen cinco categorías: derecho civil, common law, derecho consuetudinario, derecho musulmán, derecho mixto. Esta última categoría no se refiere a un sistema, sino a una combinación de sistemas.
A continuación desarrollaremos la clasificación por sistemas de derecho mixtos, tomando en consideración la información proporcionada por JuriGlobe-Grupo de Investigación sobre los sistemas jurídicos en el mundo de la Facultad de Derecho de la Universidad de Ottawa.
Sistemas de derecho mixtos
La designación de «mixto», que ha sido arbitrariamente preferida a «híbrido» o «compuesto», no debe ser entendida en el sentido restrictivo que le fuera atribuido por ciertos autores. Se encontrarán en esta categoría aquellos países donde dos o más sistemas se aplican de manera acumulativa o de interacción, como así también aquellos en los cuales hay una yuxtaposición de sistemas dado que los mismos se aplican simultáneamente a áreas más o menos diferenciadas.
